NEVADA TO HOLD HEARINGS ON HOMEOWNER ASSOCIATIONS by |
Open Letter to America: Congratulations to all the great state of Nevada, the courageous members of the Senate; the September 26th hearing, and the Voice of Homeowners, so ably represented by riend, Phil Testa My heart and spirit is with you all in this new open door to indentify the unAmerican entities known as De Facto governments, spawned and sponsored by CAI(Community Associates Institute) in 1973. I salute Senator Ann O'Connell and Senator Michael Schnieder for the courage and fortitude to investigate a cottage industry that completely violates our constitutional right to due process and equal protection through the deceptive marketing of a the greatest housing monopoly in the history of America- CAI. I remind the Senators to read the 1994 report of the Federal Trade Commission which charged CAI with unfair business, and to realize, this unfair business has left more Americans homeless than any natural disaster such as a flood or earthquake and continues to rob families of homes in non-judicial foreclosures. The Boston Tea Party was conducted to protest the unfair tax on tea...42 million Americans pay an unfair property tax and maintenance fee disguised as dues which is a double tax discrimination outlawed in the 14th amendment but existing in homeowner associations. Can we honestly call ourself the land of liberty watching thuosands of families lose all property rights and face the terror of a sheriff changing the lock on our doors, our personal belongings hauled away, our pets locked up in the humane society and our life savings lost in frame and blame litigation?? Do we dare question the conflict of interest when HUD officials granted CAI $50,000 of tax dollars in 1973 to knowingly establish that corporation composed of wealthy builders, bankers and brokers for the sole purpose of i ncreasing profits at expense of sacrificing property rights...and the fact the VA handed over $25,000 tax dollars for this private corporation misnaming itself, nonprofit-educational when the intent was a monopoly in housing, and powerful lobby arm to control and create quasi-governments that turn user friendly neighborhoods into gulags? Can we complain about human rights in other nations when a man's home is turned from a castle to a prison, and he falls victim to a hostile housing environment with hate crimes to shorten his life as they destroy his savings and peace of mind? Are we not aware there is no one wiith assurance like the man who sells insurance but the billion dollar insurance industry known as Chubb is so chummy with CAI, homeowners are profiled for destruction under the insurance purchased by those destroyed? Is not the insurance industry based on good faith and can you see good faith in forcing millions to buy a master policy that will spent a million to destroy a homeowner over a ten dollar late charge? Have we become so callus, we can forget the victims who died of heart attacks and suicide when the De Facto governments coldly drove them to the streets and kangaroo courts turned them into bankrupt refugees? Have we ever seen any Judge order the victims of a manmade landslide to pay the homeowner association $92,000 for refusing to turn on water that would re-activate the landslide beneath their already damaged home?? Does not our constitution declare any law written, city, county, state etc. that is in conflict with our constitution is void and cannot be enforced....and do not judges take an oath to uphold the constitution they so blantantly betray in HOA lawsuits?? Are not these ahesive contracts of HOAs impaired and in violation of fair trade because they never disclose the warning, "buying a home in a homeowner association can leave you homeless." Did not our forefathers offer homesteads free because homeowners make citizens more considerate neighbors and is it fair residents of homeowner associations are denied the protection of the homestead right that dates back to the Bill of Rights.... My fellow citizens, I am a world war two military widow who has been to the west coast twice this year. I live my life and dedicate my soul to the America under one God, for liberty and justice for all, but my health and budget must limit travel. There are many among you more articulate, closer to the senate, free of other responsibilities. As a member of the Florida Silver Haired Legislature I promised to be on hand for our new bills to be introduce early in October. My civil rights bill carries my heart with it for every victim of civil rights abuse in Dixie.... I have devoted my life as much to human rights as civil rights and although I am called a bird, I do not have the freedom to fly across this great land of ours at whim. I implore you to consider the actions I have taken and to weigh each responsibility to yourself and to the next generation entitled to the same liberty we once knew. I filed a complaint against CAI for conducting a housing monopoloy...I filed a complaint in Californi against CAL/CLAC lawyers for violating the conflict of interest and California Fair Political Practice Act which forbids any interested party from any direct or indirect influence upon any legislation that might enrich them financially or materially... I filed charges of violating public trust...and I ask the Justice Dept to investigate CAI for conducting a husing monopoly like as they sued Bill Gates for a monopoly on Windows. Must we consider a computer of more value or harm than the roof over our head, and must the Dept of Justice put electronics before homes? The RICO Act is difficult to prosecute but the FTC can file unfair business very easily and the Justice Dept can handle the monopoly very expert....look at Microsoft.... As I look at my calendar I come to face to face with the realization I have far more yesterdays than tomorrows. I have always placed public service before priority to my family or self and still do. But I feel I must depend on a conference phone to participate in this valued hearing because I never learned to say no in my lifetime and the car accident that totaled my car last year left some injuries that required more rest than I allowed this body. My thoughts are with you and if any change should permit me more travel in a month I must make a physical move here on the east coast, I shall not hesitate to join you. I know many strong citizens like Aliza Ross will cross the border and your schedule will be full. I only ask that a moment of silence take place for Jim Troutman and Allan Gray who died like soldiers in battle fighting an unjust war in their homeowner associations...I ask a minute to salute Vera Armstrong, the POW/MIA widow dragged from her home in handcuffs for flying the POW/MIA flag that honored her missing husband.... Most of all I ask, we remember the blood shed to give the world a land of liberty free of all shackles and we pledge to unite in every way to remove each chain that binds us and restore the Bill of Rights to each and every homeowner. America the beautiful has become America the feared and our founding father Ben Franklin warned us we all hang separate or we all hang together. In 1934 a publication called "The Organizer" warned Americans would form an imperialism of capitalism by first diving people through the process of law known as foreclosure. This wise man said, "When the common people have lost their homes, they will become more tracable and more easily governed by the strong arm of the law...." My fellow citizens, "when the law has to break the law to enforce the law we have no law." My many years of research have established homeowner associations are lawless, not just unconstitutional and CAI is a monopoly owned by trade associations that turned HOAs into a cash cow. The lawyers will milk it until there is not a drop left if the legislature elected to serve we, the people, fails to take the bull by the horn and kill the fatted calf. I am one grassroots grandma, one American devoted to upholding our Bill of Rights, so please don't settle for a bill of goods; you have the goods and all you have to do is deliver. I am as near as your phone and whether I make it this month or not, I shall once again see the golden sunset in Nevada...where history dates back to the first upheaval. Please remember when the divine creator parted the ocean waters the first soil to appear on this continent was Arizona, Nevada and Utah... I have covered your state, coast to coast and I marveled at the ancient vibrations that whispered in my ear and walked upn the ancient soil in awe...my spirit as our Indian brothers honors that earth and the brothers and sisters who live on it.... May the great spirit that unites us unite us again in this great undertaking so we speak with one voice and our hearts will beat as one heart...then the souls of our founding fathers shall once again know joy because they did not die in vain. America does not need and cannot support five levels of government and maintain the friendly, good neighbor policy we are known for. Please remember the good book warns us it will not profit a man to gain the world if he loses his soul, and those who proift off of of this unAmerican lifestyle, are depending on apathy to buy our souls....I beg you to stand up and be counted and tell them you will no longer allow them to frame and blame and you will not tolerate being placed in the position of "fight or flight" in the land of free.
