California Homeowners Thank Santa Hauser and his Elves for:

  • unlimited assessments on their homes without their consent

This Christmas card was sent to all California State legislators in 1993 by American Homeowners Resource Center.

We wanted to inform all the California legislators that Dan Hauser, CAI Santa Claus, (D) -Chairman -Assembly Housing Committee, Julie Bornstein, CAI elf (D) Member- Assembly Housing Committee , and Gil Ferguson, a CAI recruit (R) - Vice Chair were sponsoring and sucessfully shepherding anti-homeowner bills through the legislature. by misreprenting the true purpose and effects of the bills to the other legislators.

Hauser represented Arcata in Northern California, a district with very few homeowner associations. He courted and, in return, was wined and dined and funded by Southern California hoa lawyers who each farmed hundreds of homeowner associations. He helped create the lucrative, ruthless anti-homeowner HOA litigation industry. As the laws he created did not affect his consitutients they voted him back in every year until the term limits laws ended his legislative career.

His laws let lawyers harvest UNLIMITED legal fees for the collection of dues and late charges and to enforce arbitrary rules they created over the property owners. Lawyers have charged hundreds of thousands to collect a questionalble $5 late charge. Hauser legalized extortion of homeowners by orgainized collection lawyers and maintenence vendors. He legalized the confication of homes for minor amounts of maintenence dues and late charges. His laws stripped property owners of due proces, spawned fraud, corruption, terrorising of owners and a constant flood of lawsuits by ruthless hoa lawyer gang.

California homeowners do not have the basic property and civil rights that citizens have in democratic societies. As approximately eighty per cent of all new homes are in homeowner associations, most buyers are effectively forced into a homeowners association - a state mandated servitude designed to constatnly extort money from buyers under threat of foreclosure by the lawyers.

The California courts, authorities, and politicians ignore the extortion of its citizens by the lawyers. In 1999 there were 8.8 million lawsuits filed in California, many with multiple defendants. California has a population of 34 million - almost every third person is in litigation annually.

The association lawyers for whom Hauser sponsered and navigated CID laws, continue to thrive milking homeowners, association reserves, the insurance polices they forced the homeowners to purchase.

The Christmas card enlightened many. The pending bills AB1793 and AB2075 were withdrawn by their authors. Assemblymember Julie Bornstein (a lawyer, now Governor Davis' Housing Consultant) put up a furious fight for two years to give CAI AB1545, that would have put HOA assessment liens before the first trust deed. She failed.

No legislator, since, has sponsored and passed any bills for CAI in California. CAI's bills have been passed through the backdoor - by tacking on what they need to other vendors bills and co-lobbying for the bill passage..
