GRACE BUCK AND SANDI SAMMS ARE WINNING BATTLE AGAINST FORECLOSURE LAWYERS

Powerful Rick Butler Meets His Match When He Files Retaliation Foreclosures in Autumn Run, Katy, Texas


It has been reported that someone said to CAI (Community Associations Institute of Alexandria, Va) attorney Rick Butler, "There ain’t no hell" and Rick replied, "The hell there ain’t, you ain’t never met Grace and Sandi".

Grace Buck says, "We women have to fight for our homes and the CAI lawyers think it is hell". We can’t swear that this is true, but we can report that Grace Buck tells us that around the mid l990’s when she was on the board of Autumn Run, the board fired Rick Butler, attorney for Capitol Consultants.

Buck, a disabled single senior who lives alone, says. "That’s when the circus began". Through obvious actions of Capitol Consultants, sometimes known as Texas Community Management, a meeting was engineered, whereby, a stand up motion was made and carried by a show of hands to remove the entire board, change the by–laws and elect a new board.

The entire board was removed without the required 75% of owners’ votes as shown in the deed restrictions. The removed board walked out of the meeting. Immediately the new board was elected and rehired CAI attorney Rick Butler of the law firm of Butler and Haley, who soon afterwards filed foreclosures on the homes of Buck and Samms for fees which the women claimed were illegal according to the deed restrictions and Butler demanded that thousands of dollars be paid or they would lose their homes.

Sandi Samms’ brother, attorney Ronnie Samms & attorney Jeff Leahman, defended the women in their suit
for

  • (1) declaratory judgment interpreting the deed restrictions
  • (2) Breach of the deed restrictions; and (3) intimidation and harassment. (See lawsuit at www.propertyrightstexas.com). The women lost but on appeal Judges O’Connor, Hedges and Price ruled: "We reverse the trial court’s judgment granting Autumn Run’s summary judgment based on ratification, and REMAND the cause to the trial court for further proceedings".

    Grace and Sandi are victims, along with more than 2,000 other CAI foreclosure victims in Harris County.
    This foreclosure racket, so clearly shown in this case, is possible through the use of House Bill 2152(Ch204) introduced by Rep. Kevin Bailey which applies only to Harris County.
  • It was signed into law by George Bush as an obvious pay-back to the Trial lawyers who are his second largest contributors. This racket was hatched in 1973, by lawyers at Alexandria, Va., innocently calling themselves Community Associations Institute which is a "how to" school to teach lawyers the lucrative racket & how to avoid the anti-discrimination laws of 1969.

    This foreclosure racket for enrichment of CAI lawyers and the satisfaction of special interest groups who are involved in using this method of neighborhood cleansing, is most widely used in California, Florida, Arizona, Nevada, and Texas.
  • The Property Rights Foundation (email texmex@texasmexico.com) is organizing across Texas and will be asking and publicizing candidates views on property rights.
  • The Texas Constitution allows foreclosures for 3 reasons only: none payment of taxes, home improvement loans or taxes. CAI lawyers are pushing to have HB2152(203) apply to all of Texas by 2005 whereby homes can be foreclosed on for "legal fees" for letters written about such things as "spot on drive", "lawn needs edging", "door needs paint", etc.

With Tex-Mex battle cries of "Don’t Mess With Texas" & "Don’t Tread on Me" Texans have declared WWIII on CAI lawyers and are urging the FBI to investigate under RICO laws, because it is a RACKET which uses INTIMIDATION , and CORRUPTION includes boards, lawyers and politicians and it is ORGANIZED.
