Thank you for your inquiry regarding disclosures for litigation pending with Homeowner's Associations.
I would like to help you with answers to your questions; however, I am limited by my arrangements with Coldwell Banker to providing legal advice only for my clients where I am the listing or sales agent. And, that advice is limited to the aspects of the particular transaction.
With this in mind, I can offer the following suggestions.
In general, everything that would be material to a buyer in reaching a decision of whether to buy or not, must be disclosed to the buyer. There are legal exceptions. Please keep in mind that California is a consumer oriented state, and public policy is generally based upon full disclosure.
Homeowner's Associations can get valuable information and support through membership in the Community Association Institute. The Orange County Chapter is located in Mission Viejo.
